IXLEAN Terms and Conditions

Welcome to IXLEAN! These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using IXLEAN, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use our Platform.

1. Acceptance of Terms

By using the IXLEAN Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to update or modify these Terms at any time, and your continued use of the Platform constitutes acceptance of those changes.

2. Use of the Platform

You must be at least 16 years old to use the IXLEAN Platform. If you are under 16, you may only use IXLEAN under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Your use of IXLEAN is for personal, non-commercial purposes. You may not use the Platform for any illegal or unauthorized purposes, including, but not limited to, violating any intellectual property or privacy rights, or engaging in activities that could harm the Platform or its users.

3. Account Registration

To access certain features of IXLEAN, such as personalized workout plans and AI coaching, you must create an account. You agree to provide accurate and complete information when registering and to keep this information up to date. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. IXLEAN is not liable for any loss or damage resulting from unauthorized use of your account.

4. Payment and Subscription Terms

Some features of IXLEAN require payment or subscription. By purchasing any paid service, you agree to pay the applicable fees. All payments are processed through secure third-party payment providers. We do not store your financial information.

  • Subscriptions: Subscription services are billed on a recurring basis, and you agree to pay for the services for the duration of the subscription period. You can manage or cancel your subscription through your account settings.

  • Refunds: All sales are final, and no refunds will be provided unless required by applicable law.

5. IXLEAN Token (IXL) and Rewards

IXLEAN uses the IXL token as part of its ecosystem. IXL tokens may be earned through platform activities such as completing workouts, participating in challenges, and staking. IXL tokens can be used for unlocking premium features, staking, or voting in IXLEAN's DAO governance system.

  • Earning Tokens: You may earn tokens based on your activity and participation on the Platform.

  • Token Usage: Tokens can be staked to access premium services or vote on platform governance issues. Token usage is subject to the terms of our Token Policy, which may be updated from time to time.

  • No Guarantee of Value: IXL tokens are not a form of currency and do not hold any intrinsic value. IXLEAN makes no representations or guarantees regarding the value or tradeability of IXL tokens.

6. License and Restrictions

IXLEAN grants you a limited, non-exclusive, non-transferable license to access and use the Platform. You agree not to:

  • Modify, copy, or distribute any content or materials from the Platform.

  • Use the Platform for any illegal or unauthorized purpose.

  • Access the Platform using automated means, such as bots or scrapers.

  • Reverse-engineer or attempt to extract the source code of the Platform.

7. Health Disclaimer

The fitness advice provided on IXLEAN, whether by AI trainers, workout plans, or other features, is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before beginning any new exercise or diet program. Use of the Platform is at your own risk, and IXLEAN is not responsible for any injury or health-related issues that may arise from using the Platform.

8. Termination

IXLEAN reserves the right to terminate or suspend your account at any time for any reason, including violation of these Terms or any misuse of the Platform. Upon termination, your right to access and use the Platform will immediately cease, and any earned IXL tokens may be forfeited.

9. Intellectual Property

All content on IXLEAN, including text, graphics, logos, images, and software, is the property of IXLEAN or its licensors and is protected by intellectual property laws. You agree not to use, copy, reproduce, distribute, or create derivative works based on any IXLEAN content without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, IXLEAN and its affiliates, directors, officers, employees, or agents will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. This includes, but is not limited to, any loss of profits, data, or other intangible losses.

11. Indemnification

You agree to indemnify and hold harmless IXLEAN, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your use of the Platform or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms and your use of the Platform are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Bergen, Norway, or another mutually agreed location.

13. Changes to the Terms

IXLEAN may update or modify these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Platform or sending you an email. Your continued use of IXLEAN after any changes signifies your acceptance of the updated Terms.
